Q: What is a Homeowner's Association and what is its purpose?
A: A Homeowner's Association (HOA) is a formal legal entity created to maintain common areas and maintain the quality and value of properties within a specified neighborhood. It has legal authority to enact and enforce maintenance and design standards in addition to the standards established by the city.
There are four basic characteristics of common-interest, planned communities, or Homeowners Associations (HOA):
1. All owners are automatically members of a community association;
2. Governing documents create mutual obligations;
3. Mandatory fees (assessments) are generally levied against owners and used for the operation of the association; and,
4. Owners share a property interest of the association.
What every prospective buyer should know about living in a common-interest community:
1. Your home is governed by rules and regulations which you agree to obey simply by buying a unit or lot in the association.
2. Your association is governed by an elected, volunteer board of directors which enforces the rules of the association.
3. These rules might limit what you can do with the property and what kind of vehicle you can park.
4. You will have to pay regular fees or assessments to your association. If you don’t pay them, the association may take legal action.
5. The health of your association depends on the participation of its members in its affairs.

Q: How is the Rosebrook Homeowner's Association Organized/Managed?
A: The Rosebrook Homeowner's Association, Inc. is a non-profit corporation. The basic purpose of the Association is to govern Rosebrook in accordance with the governing documents known as the "Declaration, Covenant, Conditions & Restrictions".
The Association is governed by a four-person Developer Board of Directors. The Board of Directors of the Association has the power and duty to administer the affairs of the Association in accordance with the governing documents. See the company and board members profile HERE.
The Board has a management agreement with a property management company. The Property Manager is responsible for carrying out the decisions of the Board; assisting in administering the affairs of the Association; and the overall operation and maintenance of Rosebrook. The Association currently has a management contract with Rose City Property Management.
Q: Is Membership in the Association Optional?
A: No. As set forth in the governing documents, when the developer created the association anyone who purchases a lot and/or home within the Rosebrook Homeowner's Association automatically becomes a member. Membership is mandatory and only ceases when one sells their property.
Q: Does the Association have a fee as part of membership?
A: Yes. All owners who live within a homeowners association are required to pay Association Fees/Assessments, or dues, per the governing documents of their respective Association. These funds are used for the Common Expenses of the Association. These expenses are incurred in the administration, management, maintenance, and operation of Rosebrook. The governing documents for Rosebrook Homeowners Association are recorded with Smith County and the State of Texas. Copies of these documents are provided at closing to new buyers. These documents are also available on this website located in the Documents Library of the members area. (See below for instructions for payment).
The current annual assessment is $450.00 per-lot, per-year as of January 1, 2019. The assessments are due yearly on the first (1st) day of January and required to be paid by the 31st. See the following Disclaimer and Note. See Paying Your Dues for more in-depth information.
Disclaimer: the Association, through the management company will make every reasonable effort to provide you with a statement. However, failure to receive a bill does not exempt you from paying your assessments.
Note: failure to pay assessments may result in a lien on the delinquent property and legal action to collect the past due amounts. While the Association prefers not to take these actions, they are required under the terms of the Declaration. However, per law set forth by the 2011 Texas 82nd Legislature as described herein, "For text of section as added by Acts 2011, 82nd Leg., R.S., House Bill 1228, Sec. 2; see Sec. 209.0062", (click HERE to read the bill language or click HERE to read the Texas Property Code), if a homeowner is unable to meet the financial assessment responsibility, the Board and/or management company shall adopt reasonable guidelines to establish an alternative payment schedule of minimum 3 months and not to exceed 18 months. Q: What do the Association Fees cover?
A: Homeowner Association fees cover the operation and maintenance of the common areas of the HOA, insurance, repairs, and are used to provide services for the benefit of all members.

Q: I understand I am bound by restrictions and conditions within the HOA. Where do I find them?
A: Per the Covenants, Conditions & Restrictions (CCR's) of the Rosebrook Homeowners Association and the State of Texas, each homeowner should receive a copy of these legal documents with their closing papers at the purchase of your home. You may also view and/or download the CCR's and Amendments on this website. Find them in the Documents Library under the Members Area tab or click HERE to view.
Q: Does the Association have meetings?
A: Yes. There will be at least one meeting of the Association annually as specified in the By-Laws or as established by the Board of Directors. However, special meetings of the Association may be called by the Board of Directors of the Association or upon the presentation of a petition signed by at least 67% of the Owners. Notice of meetings shall be given to the Owners via mail and provided on this website.
Q: Does the Association have a set of rules/regulations/restrictions?

Q: I'm interested in repainting or making modifications to my property, including installing/painting/staining of fences, landscaping, etc. Are there procedures in place?
A: Repainting your house/trim the identical color does not need approval but repainting any other color and all other modifications/improvements undertaken on your home/lot must be approved by the Association’s Architectural Control Committee as detailed in the Rosebrook CCR's. Please submit a request/plan to Rose City Property Management mailed to: 100 Independence Place, Suite 301, Tyler, TX 75703. You may also submit your request by using the Contact Us page on this website. This option will provide the uploading of a photo or document to supplement your request. Q: I believe a violation of the rules/regulations of the HOA is taking place. What do I do?

It is crucial to be as detailed as possible with such concerns including but not limited to, the address of property, photos, and description of concern. If a violation is noted referencing a property, the property owner will be notified for resolve. If a common area needs attention, given the issue at hand, respective maintenance will be scheduled.
